Q: What happens when I receive a class action notification?

A: If you receive a notification that you are a member of a wage and hour class action, then you are one of many plaintiffs in the lawsuit. The attorneys named in the class action filing are the attorneys for all of the class members in the case; this means you cannot hire your own class action attorney to represent your individual interests unless you opt out of the class (see the next question below), and you must accept whatever financial verdict or settlement comes out of the case, even if it amounts to much less money than you may have earned.

Q: Do I have to participate in a class action lawsuit?

A: No, you do not. In general, wage and hour class action lawsuits must allow you the option to exclude yourself, or opt out, of the class action. Doing so may allow you to avoid being bound by the settlement or verdict obtained in the class action.

Q: What should I do if I do not want to participate in the class action lawsuit?

A: Under California law, the notification document you received should contain instructions that explain how to exclude yourself from the class action. However, these notifications can often be confusing, and it is best to consult an experienced class action lawyer who can examine the class action, and advise you as to whether it is in your best interest to remain a member or opt out.

Q: Should I hire my own attorney?

A: If you decide to opt out of the class action, it is critical that you consult an attorney and discuss options for recovery. Opting out means that you can sue on your own, and it is important to be represented by an experienced class action attorney who understands the crucial differences between being part of a class action and suing individually.
